Bundestag: FDP mobilizes against data retention and Facebook law

             Liberals want to introduce a bill on "Strengthening Civil Rights" to the Bundestag on Tuesday. On the hit list of the faction are the logging of user traces and deletion obligations for social networks.
            

        

        The FDP parliamentary group wants to make serious with promises from the election campaign and is taking a concrete step against the legal requirements for providers to the unpolluted data retention and for platform operators to delete "obviously punishable content". The Liberals are planning to introduce a bill on "Strengthening Civil Rights" to Parliament on Tuesday. The first reading of the initiative is currently on the agenda of the plenary session in the early afternoon.
"Our goal is a turnaround in domestic and legal policy," said FDP faction Vice Stephan Thomae the project compared to the "Rheinische Post". The law on data retention must go just as the network enforcement law, both from the time of the grand coalition come. In the light of the relevant case-law of the European Court of Justice (ECJ), the Liberals clearly regard the unauflosem logging of user traces as "unconstitutional and contrary to European law". The rules against hatred, hate and false reports on the Internet are "constitutionally at least doubtful". Therefore, the legislature can not wait until the Federal Constitutional Court may cash the laws, but must take action itself.
Both edges on the same strandWith the Network Enforcement Act, the FDP is not the first faction to oppose the unloved black-and-red legacy. The AfD is already pleading with its own draft for completely overriding the "Facebook law". This constituted "a serious interference with the right of free speech", privatized the enforcement of the law and instilled censorship. The Left has also sketched out a bill, with which they want to repeal the fiercely contested set of standards, at least in part. Both initiatives will be discussed for the first time on Wednesday afternoon in plenary.
The CDU, FDP, Greens and CSU had agreed in the final rounds of the probe for the ultimately failed Jamaica coalition, set to unpolluted data collections and the associated monitoring. Currently, the data retention is in fact suspended after a decision of the Higher Administrative Court of North Rhine-Westphalia and a decision of the Federal Network Agency in this country. In the EU Council, however, plans for a new European initiative are in full swing.
