Authoritarian States: Germany grants export licenses for spyware and cryptosoftware in millions of millions

             From 2014 to 2016, the Federal Government approved the export of monitoring and interference technology to countries such as Egypt, Saudi Arabia or the United Arab Emirates valued at more than 3.3 million euros.


        In the summer of 2015, the Federal Cabinet tried to close gaps in the export control of spy software and, among other things, to record systems for the retention of data. However, current statistics raise doubts as to whether or not they succeed in practice in any case. For example, the Federal Government has issued export licenses for surveillance, security and interference technology in the Internet, fixed-line and mobile communications sectors in authoritarian states in the Near and Middle East for the years 2014 to 2016, amounting to more than 3.3 million euros a now published response to a request from the Bundestag's Green Party.
These are therefore nine licenses covering transactions with Egypt, Algeria, Morocco, Nigeria, Saudi Arabia and the United Arab Emirates. The Ministry of Economic Affairs is talking about "a small number of permits to a few companies and countries". In order to preserve the "constitutionally protected business and business secrets" of the companies involved, the department does not want to reveal any details. It is not possible to further break down the released exports as this might lead to conclusions on individual suppliers and transactions.
More permits for EgyptThe subcategory of products subject to authorization includes equipment for the provision of mobile communications services, as well as systems, programs and equipment for "information security" and encryption, as well as for Internet and mobile monitoring, including state trojans. The superordinate group for goods in the field of "telecommunication and information security" generally also includes, for example, radio equipment, direction finding equipment or "telecommunication test equipment". In the past three years, the Federal Government has approved 241 individual applications and collective export licenses with a value of goods worth 87 million euros.
These export licenses were for a total of 17 countries. The permits for Egypt, for example, rose from 15 in 2014 to 21 in the previous year. In the meantime, civil rights activists complain that the Federal Police and the Federal Criminal Police Office (BKA) are training the security authorities in the country on the Nile, thereby supporting the persecution of homosexuals and activists. For Saudi Arabia, the number of permits has increased from one to ten in the same period. For the United Arab Emirates, the response is a reduction of 17 to 12 export authorizations.
Reform of the "Dual-Use Regulation" The Federal Government also welcomes the fact that in September 2016 the European Commission presented a controversial draft for a reform of the "Dual-Use Regulation". It explicitly supports the objective of the amendment to create a modernized export control for goods with military and civilian use. This included, in particular, the aim of "further developing export control" with a view to the sustainable protection of human rights ".
